ALGIERS – Constitutional law experts have reacted to the solution to the current political crisis advocated, Tuesday, by Lieutenant General Ahmed Gaïd Salah, Deputy Minister of National Defense, Chief of Staff of the Army People’s National Police (ANP), namely the application of Article 102 of the Constitution, considering it as the only “constitutional alternative” to preserve the stability of the country.
For the constitutional law professor, Walid Laggoune, the application of Article 102 of the Basic Law, declaring the state of impediment of the President of the Republic, is “the only alternative and the only legal and constitutional instrument” that “exist to avoid a situation outside the constitutional framework.
Professor Laggoune, who hailed the National People’s Army (ANP) declaration “in favor of popular expression”, has stated in statements to the press that it is now up to the Speaker of the Council of the Nation to declare the state of impediment, in accordance with the prerogatives conferred on it by the Constitution in this matter.
“We have returned to text of the Constitution “before April 28, date of expiry of the mandate of the President of the Republic in office,” he highlighted.
He recalled that, in accordance with the provisions of the Constitution, the Speaker of the Council of the Nation will ensure the interim on time, once the state of impediment is declared by the President of the Constitutional Council and validated by Parliament by the two-thirds majority.
The chief of staff of the ANP estimated, Tuesday, “necessary, even imperative to adopt a solution to get out of the crisis, which meets the legitimate demands of the Algerian people, and guarantees compliance with the provisions of the Constitution and the maintenance of the sovereignty of the State “.
