Application of Article 102: Leader of Islamic party “FJD” Abdallah Djaballah refuses


Algeria – Abdallah Djaballah, president of the Justice and Development Front (FJD), denied the appeal of Ahmed Gaid Salah, deputy minister of defense and chief of staff, regarding the implementation of article 102 of the Constitution, declaring the vacancy of the Presidency of the Republic.


The leader of the Islamist party has called for the application of Article 7 of the Constitution (the people is the source of all power). “Our initiative is also constitutional contrary to what some parties are trying to spread for reasons that are still unknown,” he added.

Meanwhile, Djaballah announced a new opposition meeting to discuss the army’s decision.

The Chief of Staff called, yesterday, for the implementation of Article 102 of the Constitution which stipulates the vacancy of the post of President of the Republic.

This article stipulates: “When the President of the Republic, because of serious and lasting illness, is totally unable to perform his duties, the Constitutional Council meets, and after having verified the reality of this impediment by all appropriate means, proposes, unanimously, to the Parliament to declare the state of impediment.

“The Speaker of the Council of the Nation takes over as “interim president” until new  election is held. That decision has to be approved by a two-thirds majority in both houses of the parliament.”

The article allows the «removal of the president from office on the grounds of medical issues or other problems such as the inability of «exercising his functions.”

The article grants, also, the presidency of Algeria, for 135 days, to the Speaker of the Council of the Nation, the upper house in the Algerian parliament.
