Lieutenant General Ahmed Gaid Salah, Deputy Minister of National Defense and Chief of Staff of the National People’s Army called for the application of the Article n 102, appointing the current Speaker of the Council of the Nation Abdelkader Bensalah as a “Provisional President” or caretaker replacing Abdelaziz Bouteflika because of his illness and disability to carry on his duties.
The announcement comes as part of the Chief of Staff of the National People’s Army, Army Corps General Ahmed Gaid Salah ‘s working visit to the province of Ouargla to supervise a tactical exercise with live ammunition to control the 2nd phase of combat readiness, inspect certain units and hold orientation meetings with executives and staff of the 4th Military Region.
Ahmed Gaid Salah called for an immediate solution, with reference to the Constitution in force. According to him, this solution appears in Article 102 of the Constitution.
“It is necessary, even imperative, to adopt a solution to get out of the crisis that responds to the legitimate demands of the Algerian people and that guarantees the respect of the provisions of the constitution and safeguards the sovereignty of the state,” Salah said in a speech broadcast by private television station Ennahar on Tuesday.
That solution, he said, was in the implementation of Article 102.
This article stipulates: “When the President of the Republic, because of serious and lasting illness, is totally unable to perform his duties, the Constitutional Council meets, and after having verified the reality of this impediment by all appropriate means, proposes, unanimously, to the Parliament to declare the state of impediment. “
“The Speaker of the Council of the Nation takes over as “interim president” until new election is held. That decision has to be approved by a two-thirds majority in both houses of the parliament.”
The latter allows the «removal of the president from office on the grounds of medical issues or other problems such as the inability of «exercising his functions.
