MOSTAGANEM (Algeria)- Chairman of the High Independent Authority for Elections Monitoring (HIISE), Abdelwahab Derbal said Monday in Mostaganem, that the Authority is independent and commits to comply with the law.
Holding a news conference in the HIISE province’s office, Derbal pointed out that the Authority is a “body which does not depend on anyone (candidates, administration and justice),” stating that “no one can undermine its independence”.
The Electoral Law is more focused on the candidacy papers submitted to the Constitutional Council than on the candidate to the presidential election.
The Articles 139 and 140 of the Electoral Law take into account the case of the candidacy papers and not that of the candidate, contrary to the Article on the legislative elections, added the president of the HIISE.
For the legislative elections, the law provides for that the candidate, head of the list, has to submit the candidacy file. Exceptionally and with a valid reason, the second candidate on the list can submit the file.
“The candidacy for the presidential election is not by list. It engages a single candidate and the rules of the Constitutional Council are clear,” he said.
The law is above all consideration and that a law, despite its imperfection, is more adaptable than an opinion, he concluded.
